## Abstract

This interim final rule implements a new program established by the Transportation Equity Act for the 21st Century (TEA-21) Restoration Act, which provides for the transfer of Federal-aid highway construction funds to 23 U.S.C. 402 State and Community Highway Safety Program grant funds for any State that fails to enact and enforce a conforming ``repeat intoxicated driver'' law. This regulation is being published as an interim final rule, which will go into effect prior to providing notice and the opportunity for comment. Following the close of the comment period, NHTSA will publish a separate document responding to comments and, if appropriate, will revise provisions of the regulation.
