Procedural Rules for DOE Nuclear Activities; General Statement of Enforcement Policy

The Department of Energy (DOE) is amending its General Statement of Enforcement Policy (Policy), which is contained in an Appendix to the Procedural Rules for DOE Nuclear Activities. DOE has reevaluated this Policy in consideration of the changing mission of DOE and experience gained from applying the Policy since its publication. Under the amended Policy, DOE no longer intends to base civil penalty amounts on the type of nuclear facility involved. The amended Policy also adds new sections on (1) DOE's use of enforcement letters to close out investigations, (2) self-identification and tracking systems, and (3) self-disclosing events.
