On June 6, 2008, EPA Region 9Âs Emergency Prevention and Preparedness Section (EPPS) enforcement team resolved a Clean Air Act 112(r)(7) Risk Management Plan (RMP) program violation at the J.R. Simplot Company facility located in Orland, California. Simplot failed to prepare and implement written procedures for safely transferring ammonia from a tanker truck to a storage tank, as required by CAA section 112(r)7 and 40 C.F.R. § 68.52(a). The Facility also failed to prepare and implement an on-going mechanical integrity program for the ammonia storage tank, as required by CAA section 112(r)7 and 40 C.F.R. § 68.56(a).
