This referral seeks collection of a $113,115 administrative penalty assessed in an August 24, 2007 Default Order and Initial Decision for a CAA 112r violation ($67,011) and EPCRA 312 violations ($67,104). Altex Distrubtings Inc., (Altex) failed to submit a risk management plan for its storage of chlorine as required by 40 CFR Section 68.150 and CAA 112(r). Altex also failed to submit Tier II reports for its use of chlorine and sulfur dioxide as required by EPCRA 312. The Default Order became final on October 9, 2007. Penalty payment was due November 8, 2007 Penalty has not been paid. Finance Office has sent three (3) Delinquency Notices.
