Summary

On October 10, 2003, a Consent Agreement and Final Order (CAFO) was filed resolving violations of the Asbestos Hazards Emergency Response Act ( AHERA ) under the Toxic Substances Control Act ( TSCA ). The Diocese of Richmond is considered the Local Education Agency (LEA) because it owns a building being leased by Blessed Sacrament Huguenot located on 2501 Academy Road in Powhatan, Virginia. The notice alleges that the Diocese of Richmond failed to conduct 3 year reinspections 40 C.F.R. ' 763.85(b)(1). Blessed Sacrament Huguenot contains 2,127 square feet of asbestos-containing floor tile throughout the building. Approximately 100 students attend Blessed Sacrament Huguenot. Blessed Sacrament Huguenot also employs about 75 people. Management plans are used to note the location and condition of asbestos-containing materials (ACM) through-out the school. It is the responsibility of the designated person to ensure that the management plan is maintained and updated as required by AHERA. A management plan helps prevent exposure to asbestos by ensuring that any maintenance or other routine school activities will not result in the disturbance of ACM. In addition, whenever ACM needs to be disturbed, only accredited persons are used by the school. Annual notification on the availability of the management plan, allows parents, teachers, and employee organizations the opportunity for reviewing all information regarding ACM in the school. Diocese of Richmond has spent $6,000.00
