Summary

Respondent is an offshore operator in the oil and gas exploration and production industry operating at High Island 389 in the Western Portion of the Gulf of Mexico inside the Flower Gardens National Marine Sanctuary. This Order is a schedule order requiring Respondent to come into compliance with the NPDES discharge permitting program. Their current general permit does not authorize discharges into areas of biological concern meaning their discharges from this facility are not authorized by their permit. Respondent has been given a schedule to work with EPA's NPDES permit writers to modify the current general permit to authorize these discharges. The Administrative Order also places limitations on these discharges until the new permit can be issued. Even though under a schedule order by EPA, Respondent will not be in compliance until the new permit is issued, coverage is authorized, and Respondent complies with the terms and conditions of the new permit.
