## Summary

Fourteen alleged violations of the CAA and other RCRA violations have resulted from the March 2002 CAA inspection of the Safety Kleen, Denton, TX, Facility. Violations of the CAA involve HAPs (NESHAP) and NSPS, as well as a violation of the SIP. The enforcement case was referred to the Department of Justice 9/08/2003. Because of the Safety-Kleen bankruptcy case, EPA filed a Request for Payment of Admin Expenses on 9/15/2003. After several rounds of negotiation, EPA accepted the company's offer of $150,000 direct cash payment to DOJ to settle this case separately, outside of EPA's greater claims for other cases that were part of the bankruptcy proceeding. There were no uncompleted corrective actions, as outlined in the company's correspondence to EPA. Supporting paper records from the original case file were scanned and saved in support of reconstructing the ICIS record in Dec 2025 to close it out.
