Tree Belt Feed Yard, Inc. (OKG010078), Gage, Oklahoma: At all times relevant to this Order, Respondent, John Smithson owned or operated a feed operation, located at Gage, in Ellis County, Oklahoma, with a mailing address of Route 2, Box 11, Gage, Oklahoma 73843.  The facility is an ï¿½animal feeding operationï¿½ and a large ï¿½Concentrated Animal Feeding Operationï¿½ (CAFO) as defined in the NPDES General Permit and the Federal Regulations.  On July 3, 2003, the facility reported a June 20, 2003 effluent discharge into Dry Creek to the Oklahoma Department of Agriculture, Food, and Forestry (ODAFF).  The NPDES requires both State and Federal notification within 14 days.  The ODAFF responded in a July 14, 2003, to the facility and relayed this information to the EPA on August 4, 2003.  The discharge report states retention pond levels were higher that normal to irrigate 60 acres of sprigged Bermuda grass.  This Order requires the facility to submit documentation and schedule a Show Cause meeting with the EPA on proper notification and that the AWRS retention ponds are maintained at correct levels to retain a 25-year, 24-hour rainfall event.
