THIS IS A SETTLEMENT PURSUANT TO A PROSPECTIVE PURCHASER AGREEMENT (PPA) ENTERED INTO BY EPA AND JACKSON TOWNSHIP FOR THE WHITMOYER LABS SUPERFUND SITE AND ADJACENT PARCELS (THE PROPERTY ). PURCHASER AGREES TO IMPLEMENT INSTITUTIONAL CONTROLS PURSUANT TO THE ROD-OU3 AND TO MAINTAIN THE INTEGRITY OF THE SOIL COVER THROUGH RESTRICTIVE COVENANTS (AS SET FORTH IN THE PPA).
A PROSPECTIVE PURCHASER AGREEMENT (PPA) WAS ENTERED INTO BETWEEN EPA AND JACKSON TOWNSHIP REGARDING A COVENANT-NOT-TO-SUE FOR EXISTING CONTAMINATION AT THE WHITMOYER LABS SUPERFUND SITE, LEBANON COUNTY, PA RESOLVING LIABILITY UNDER CERCLA SECTION 106, 107.
