Summary

The Consent Decree with sulfuric acid producer DuPont finalizes a global settlement involving four sulfuric acid plants in Ohio, Louisiana, Virginia, and Kentucky. The Consent Decree resolves violations of EPA?s New Source Review (NSR)and New Source Performance Standard (NSPS) regulations, as well as Title V permitting requirements. DuPont will reduce emissions nationally of SO2 by over 13,600 tons per year by accepting SO2 emission limitations reflective of state-of-the-art pollution control equipment. DuPont will also accept emission limits for sulfuric acid mist and install a continuous emissions monitoring system on each plant. Note: The total penalty values, emission reduction numbers, and cost values provided above are for the Region 5 facility only. This is a global settlement that includes plants in Regions 3, 4, and 6 in addition to Region 5.
