Summary

On June 5, 2003, U.S. EPA issued an Administrative Compliance Order (Docket No. V-404-AO-03-04) to Mr. Richard M. Osborne, Mr. Martin Hathy and Lake Erie Iron & Metal Company, Inc.(LEIMCO), all of Painesville, Ohio, for violations of the Federal Clean Water Act (CWA). The Compliance Order alleges that Osborne, Hathy and LEIMCO discharged pollutants into 34 acres of wetlands without a Section 404 CWA permit from the U.S. Army Corps of Engineers (Corps). The wetlands were determined to be jurisdictional under the CWA because they are adjacent to a tributary of Black Brook, which flows to Mentor Marsh and Lake Erie. The Compliance Order requires corrective actions to be taken, including submittal of an 68 acre wetlands replacement plan to mitigate the violation.
