AO issued 10/24/2003. Respondent submitted their annual report for calendar year 2002, as per 40 CFR � 503.28, and reported groundwater monitoring well date for the Hay Valley Sludge Disposal Facility. The Hay Valley Sludge Disposal Facility is an active sewage sludge unit owned and operated by the Respondent. Nitrate-nitrogen groundwater data indicated greater than the maximum contaminant in 40 CFR � 141.62(b). The Respondent generates and disposes Class B pathogen sewage sludge and is required to adhere to the management practice as per 40 CFR � 503.24(n)(1). Based on the findings, the Respondent violated the managment practice as per 40 CFR � 503.24(n)(1).
