## Summary

On November 26, 2003, Region III issued an Administrative Complaint against Dominion Transmission, Inc., ( Dominion ), pertaining to violations of Section 311(b)(3) of the Clean Water Act, as amended, ( CWA ), 33 U.S.C. ï¿½ï¿½1321(b)(3).  The violations occurred as a result of two separate discharges of oil from pipelines operated by Dominion in Calhoun County and Lewis County, West Virginia, into waters of the United States between July 2002 and July 2003.  The Administrative Complaint was issued pursuant to Section 311(b)(6)(B)(i) of the CWA, 33 U.S.C. ï¿½ï¿½1321(b)(6)(B)(i), and proposed an aggregate  Class I penalty of $10,950.00.  Dominion did not contest the allegations of the Complaint and it agreed to pay the proposed penalty to resolve the matter.  On March 29, 2004, a Consent Agreement and Final Order were filed with the Regional Hearing Clerk.  Dominion is required to pay the penalty by April 28, 2004
