This Agreement and Covenant Not to Sue is entered into by EPA, Colorado Department of Public Health and Environment, and Home Depot. The primary purpose of this Agreement is to settle and resolve the potential liability of Home Depot for the present contamination at the Robinson Brick Company Property which may result from Home Depot's acquisition of the property for construction of a retail sales facility.
