On December 18, 2003, a Consent Agreement and Final Order (CAFO) was filed resolving a violation of Section 7 under the Federal Insecticide, Fungicide and Rodenticide Act. All EPA registered pesticide-producing establishments are required to submit by March 1 of the current year (March 3 this year because March 1 fell on a Saturday), a pesticide production report stating amount of pesticides produced at the establishment in the past year, and how much the company expects to produce in the upcoming year. UAP Northeast, Inc. failed to submit an annual pesticide production report by the March 3, 2003 deadline for their facility located in York, PA. As agreed upon in the consent agreement, UAP Northeast, Inc. has requested the termination of its Establishment Number and will not have to pay a penalty
