VIOLATIONS: The Respondent's tank battery facility was a point source discharge of pollutants , specifically brine, to the receiving waters of a tributary to Salt Creek, located in the Southwest Quarter of Section 35, Township 15 North, Range 11 East, Okmulgee County, Oklahoma. The discharge of brine was documented during a September 17, 2003 inspection.
RELIEF: The Order specifies that the Respondent should also take steps to cease all discharges of pollutants and to neutralize the brine contaminated area south of the tank battery by applying soil amendments to neutralize the sodium chloride. Additionally, the Order asks the Respondent to consider: (1) remove and properly dispose of contaminated fluids (2) re-constructing the secondary containment; (3) installing a sump pump to remove and re-circulate standing fluids from the secondary containment to the tank; and (4) repairing or replacing leaking equipment. A follow-up inspection will determine the extent of compliance with the Order.
