Summary

Star Metals was a secondary aluminum processing facility subject to the NESHAP for Secondary Aluminum Production. As an area source, it was subject only to emission limits for dioxins and furans (D/F) at its affected sources. Star Metals operated a rotary scrap dryer subject to the D/F emission limit. Performance testing of the rotary scrap dryer in May 2003 showed D/F emissions to be 828 times the standard. According to a Star Metals contact, when they received the test report, they decided to shut down the facility. The matter was referred to Indiana Dept. of Environment (IDEM) enforcement by the IDEM stack test reviewer, who also forwarded the stack test result to USEPA. USEPA issued Star Metals a Finding of Violation in December 2003. Upon receiving the FOV, Star Metals contacted USEPA to inform us that the facility had been shut down. In late January or early February 2004, USEPA is issuing a unilateral Order to Star Metals, requiring 1) documentation of the date of shut down, 2) that STar Metals request IDEM to revoke their permit and send a copy of that request to USEPA, 3) that Star Metals submit to USEPA a copy of IDEM's response, and 4) that Star Metals apply for a new permit before restarting any secondary aluminum production at the Petersburg, Indiana, site.
