Porter Construction, Amarillo, TX (TXU010382): A storm water compliance inspection was conducted by EPA at the site of the Pak A Sak in Amarillo, TX, on February 5, 2004. Porter Construction was the general contractor for the project and met the definition of �operator� as defined by the Texas Storm Water General Construction Permit. Violations cited were failure to develop and implement a Storm Water Pollution Prevention Plan (SWPPP). Because the Texas Storm Water General Construction Permit specifically states an operator is automatically covered under the permit if a SWPPP is developed, Porter Construction was also cited for not having permit coverage because there was no SWPPP.
