Respondent is an operator constructing homes in the Unit 17 subdivision in Rio Rancho, New Mexico. EPA inspected the facility on March 11, 2004 and found that Respondent had failed to obtain it's NPDES storm water construction general permit and failed to have prepared or implemented a Storm Water Pollution Prevention Plan. Respondent is being Ordered to develope a Storm Water Pollution Prevention Plan in compliance with the permit and implement the called for Best Management Practices at the site.
