Respondent is a Texas county that assisted the local hospital district in constructing a hospital. Respondent was an operator of the construction site controlling the day-to-day activies of the site work outside of the buildling foot print. Resopndent failed to obtain the NPDES storm water construction general permit for storm water discharges. Respondent was inspected on March 7, 2004, and found to have poor erosion controls and the paperwork did not meet the permit requirements. Respondent is being ordered to comply with this Clean Water Act and this permit.
