Respondent is a partnership, under the laws of the state of Texas, and operates a residential construction site and as such, is a permittee; subject to regulations of the Clean Water Act (CWA), National Pollutant Discharge Elimination System (NPDES) Storm Water Regulations. The Permittee owned or operated the Ponderosa #3 construction site, located at 3102 Burnet, Laredo, Webb County, Texas 78045. The Respondent discahrged pollutants in and with it's storm water to the receiving waters of the Rio Grande River, which is a water of the U.S. The Respondent was in violation of the CWA and is being issued an Administrative Order for Compliance.
