ROCK POINT DEVELOPMENT, LTD (TXU010443): An inspection was conducted on March 17, 2004, by EPA to evaluate compliance by Rock Point Development, Ltd, with the Texas Construction General Permit. The site was the Crest Gate Addition, Section 37 in Midland, TX. It was determined at the time of the inspection that Rock Point Development, Ltd, had not prepared a Storm Water Pollution Prevention Plan (SWPPP) not had they applied for permit coverage under the general permit. An Expedited Settlement Offer (ESO) was drafted because although the Respondent was in non-compliance with the Clean Water Act, they did meet the criteria for the Offer.
