Respondent is a commercial construction operator at Pita-Mangana Elementary School who discharges pollutants in its storm water discharges to waters of the United States. Respondent was inspected and EPA determined that Respondent failed to properly implement Best Management Practices in accordance with NPDES permit requirements and failed to properly execute all the requirements for the Storm Water Pollution Prevention Plan (SWPPP). Respondent has certified that it has come back into compliance with the NPDES storm water requirements and is settling with EPA through the Storm Water Expedited Settlement Offer program.
