JULIAN P. BARRY GENERAL CONTRACTOR, LP (NMU001409): A storm water compliance inspection was conducted by the New Mexico Environment Department on March 24, 2004, to evaluate the compliance of Julian P. Barry General Contractor, LP, with the EPA Construction General Permit at the construction site of Old Post Plaza in Roswell, NM. It was determined that at the time of the inspection that the Respondent had neither developed a Storm Water Pollution Plan (SWPPP) nor applied for permit coverage as required by the Clean Water Act. Because the Respondent met the criteria of the Expedited Settlement Offer (ESO), that enforcement action was issued and accepted.
