TEXARKANA PAVILION, LP(TXU010404): Respondent was owner/developer for the Texarkana Pavilion, in Texarkana, TX. Although they had developed a Storm Water Pollution Prevention Plan (SWPPP) and had permit coverage under the federal Construction General Permit, they had failed to reapply to the Texas Commission on Environmental Quality (TCEQ) once the TCEQ reissued that permit on March 5, 2003. The inspector noted the SWPPP deficient. Because the Respondent met the criteria, an Expedited Settlement Offer (ESO) was drafted and routed for signature.
