Phelps Dodge Tyrone, Inc., operates a copper mine in Grants, New Mexico. Due to a heavy rain on July 25, 2004, their impound from their No. 3 stockpile discharged about 1800 gallons of acidic leach from the No. 2 Canyon and into Mangus Creek. This industrial wastewater discharge was not authorized by their NPDES storm water permit.
