This is a Civil Judicial Referral pursuant to CERCLA Sections 104(e) and 107 and the Federal Debt Collection Procedures Act, 28 U.S.C. Sections 3304(a) and (b), asking the Department of Justice to initiate litigation against Powerine Oil Company, CENCO Refining Company, and Energy Merchant Corporation. The referral asks that a Complaint be filed seeking cost recovery under CERCLA Section 107 from Powerine and CENCO and injunctive relief and penalties from Powerine and Energy Merchant. In addition, the complaint will seek a remedy under the Federal Debt Collection Procedures Act against Powerine and Energy Merchant for a fraudulent conveyance of Powerine's assets.
