The respondent, Bean Stuyvesant, failed to perform an ordered SEP in accordance with the final order that was signed and certified under penalty of law in December 2004. A demand letter was sent on March 29, 2006, serving as written demand by EPA for stipulated penalties, required under the final order. Additional stipulated penalties were sought through the demand letter of $64,000 and were paid on January 31, 2007.
