This facility, Clayton Cattle Feeders, Inc., was inspected on November 21, 2003. The inspection revealed that the facility was in violation of its permit requirements by operating without adequate capacity to contain wastewater and storm water runoff. Inspectors observed that the lagoon was basically full of solids. The permit requires the facility to design, construct, operate, and maintain a wastewater retention structure with adequate capacity to contain all the process-generated wastewater plus runoff from a 25-year, 24-hour storm event. This facility also did not keep proper records to document that the lagoon is properly maintained to contain all waste plus runoff generated during major storm events, such as the 25-year, 24-hour storm event. EPA is issuing this Administrative Order to require the facility to come into compliance with its permit by providing documentation to EPA to prove that it has adequate capacity to contain all waste plus stormwater runoff.
