VIOLATIONS OF NPDES PERMITS AT 61 WASTEWATER TREATMENT PLANTS THROUGHOUT PUERTO RICO. RECOMMEND ACTION BE TAKEN TO SECURE INJUNCTIVE RELIEF REQUIRING THE DEFENDANT TO OPERATE AND MAINTAIN THESE PLANTS IN ACCORDANCE WITH THEIR RESPECTIVE NPDES PERMITS AND THE CWA, TO MAKE CAPITAL IMPROVEMENTS WHERE NECESSARY TO ENSURE COMPLIANCE, AND TO OBTAIN A PENALTY FOR THE VIOLATIONS THAT HAVE OCCURRED.
On January 10, 2007, the District Court of Puerto Rico entered the Consent Decree in this case. The settlement resolves the case filed against the Defendant for violations at sixty-one of its wastewater treatment plants. The Defendant will pay a cash penalty and complete a supplemental environmental project (SEP). The SEP requires the Defendant to identify one or more communities not currently connected to the wastewater treatment system and to connect such community(ies) to one of its treatment facilities.
