CAFO issued 9/14/2004, assessing a penalty of $25,000. Respondent shall make the first payment of $6,250 within thirty days. The last payment of $6,250 is due by 9/2005. Respondents violated Parts VI.D and VI.N of the Permit by failing to properly design, install and maintain the temporary sedimentation pond located on Johnson Lake, a navigable water. Respondents violated Part I.V.D.2.a(1) of the Permit by failing to provide stabilization measures along the sedimentation pond. Respondents violated Parts VI.D and VI.N of the Permit by failing to take all reasonable steps to minimize or prevent any sediment discharges whcih may have an adverse impact on human health or the environment, and by failing to properly maintain protection at the outfall and perimeter controls. Inspectors observed sediments leaving the Facility at the the outfall and at perimeter controls. Respondents violated Parts V.D and VI.N of the Permit by failing to maintain structural practices, specifically storm drain inlet/outlet protection, sediment traps and silt fencing, to divert flows from exposed areas, store flows or limit runoff and discharge of pollutants from exposed areas of the site
