Respondent is drilling a drinking well for the Ruidoso High School and working at the direction of the Village of Ruidoso. On September 16, 2004, Respondent's drilling activities resulted in discharges of drilling materials (mud, water, debris, and foam 5 feet high and 100 yards long) into Gavilan Creek bed. Respondent did not have an NPDES permit to discharge pollutants to waters of the U.S.
