Respondent failed to timely submit Tier II reports for cement and fly ash to the State Emergency Response Commission (SERC), the Local Emergency Planning Committee (LEPC) and the fire department with jurisdiction over the facilities for calendar years 2002 through 2003. Respondent submitted the reports to the appropriate agencies on April 21, 2004.
