Summary

Sought access to the site, and a warrant was obtained, dated July 11, 2002, which provided access to perform a site investigation. Thereafter, it was determined that removal activities were necessary at the Site. A complaint was filed on March 23, 2004, seeking an Immediate Order in Aid of Access. The complaint was served on the defendants, and no defendant appeared, answered, or made any motion in response to the complaint. Thereafter, on May 5, 2004, DOJ filed a notice of motion, for the entry of a default judgment. On May 28, 2004, the judge signed this judgment, which required defendants to provide access to EPA to the Site for the removal action for nine months.
