EPA seeks the filing of a judicial action to recover EPA's past costs under Section 107(a) of CERCLA, assess penalties under Section 106(b)(1) of CERCLA (for failure to comply with an administrative order (EA# 02-2002-2007)), assess punitive damages under 107(c)(3) of CERCLA (as a result of the failure to comply with an administrative order), and penalties under 104(e)(5)(B) for failure to fully comply with an information request sent pursuant to Section 104(e) of CERCLA. EPA is currently performing a removal action at the Site.
