The Village of Ruidoso and the City of Ruidoso Downs jointly operate a wastewater treatment plant in New Mexico. The municipalities were issued a permit with a 3-year construction schedule to comply with new tighter phosphorus limits, and they were to be in compliance by January 2004. The municipalities have not yet begun construction or other solutions to this permit requirement and began violating phosphorus limits starting in January 2004. The limits are some of the tightest in the country and may require special treatment units to comply. EPA is ordering them to comply with the permit and propose a solution to these effluent violations.
