This is a Notice of Noncompliance (NON) / Notice of Determination (NOD) issued under the Toxics Substances Control Act (TSCA) to the Hawaiian Electric Company (HECO). The violation involves the one-year storage requirements for the disposal of PCBs and PCB related waste. The Respondent submitted a self-disclosure for actions taken at their facility. EPA evaluated the circumstances and determined them to be of such a nature that an administrative complaint was unnecessary. As resolution of the self-disclosure, EPA has issued the present NON / NOD allowing 100% mitigation in lieu of any further action.
