Summary

This Administrative Compliance Order, pursuant to section 309(a) of the CWA, was issued to Aptos Corporation due to findings made during EPA's inspection of the Facility on January 14, 2004. This Order was issued due to failure to comply with Federal categorical pretreatment standards at 40 CFR 403 and 433.17. Aptos has been discharging wastewater with a pH value less than five, which is the minimum pH value at which wastewater may be discharged under the Federal pretreatment standards. Aptos also discharged wastewater to the sewer system that contained lead in concentrations higher that the Federal limits. Finally, Aptos is in violation of the reporting and resampling requirements under 40 CFR 403.12(e) and (g). The Order directs Aptos to submit a preliminary engineering plan and begin monitoring the Facility's wastewater discharge to verify that they have come into compliance with the pretreatment standards at 40 CFR 433.17.
