On March 4, 2005, EPA issued a Notice of Determination (NOD) based on self-disclosures provided by Supelco, Inc. for violations of Section 313 of EPCRA at its facility located at 595 North Harrison Road, Bellefonte, Pennsylvania.
Supelco disclosed by letter dated November 5, 2004 that it had failed to submit Toxic Chemical Release Inventory Forms (Form R) for dichloromethane and methanol for reporting year 2003. The total gravity-based civil penalty for these EPRCA violations would be $25,358.000. However, because Supelco satisfied all of the conditions of EPAs Self-Disclosure Policy and the amount of economic benefit gained is insignificant, EPA waived the civil penalty for the disclosed violations.
