On March 1, 2005, Atlantic Wood Industries, Inc. (AWI) entered into a prefiling negotiation and Consent Agreement/Final Order with EPA Region III for RCRA violations at its Newsoms, Virginia facility. On numerous occasions during the past four years, AWI failed to remove listed hazardous waste, F035, from its 90-day storage area in a timely manner. In addition, AWI���s drip pad for its wood treatment operation had broken curbing in several areas, and was not inspected after storms. AWI also had RCRA manifest, contingency plan, and personnel record violations. AWI agreed to pay a civil penalty of $46,028.00 and to immediately comply with RCRA.
The AWI CA/FO represents the first prefiling settlement resulting from EPA Region III���s implementation of the national wood treater initiative which is ongoing. AWI , a Savannah, Georgia corporation, operates five wood treatment facilities, two of which are located in EPA Region III.
