On March 8, 2005, EPA issued a Notice of Determination (���NOD���) pursuant to the EPA���s Small Business Compliance Policy to The Erie Ceramic Arts Company, LLC���s (���Erie���), 3120 West 22nd Street, Erie, PA, based on self-disclosures provided for violations of Section 313 of EPCRA.
In its letters, Erie disclosed that the Facility had failed to submit Toxic Release Inventory Forms (���Form Rs���) for Barium compounds (���cpds.���); Cobalt cpds.; Copper cpds.; Manganese cpds.; Nickel; Nickel cpds.; Zinc cpds.; Lead and Lead cpds. for the reporting years 1999 through 2003 as required by Section 313 of EPCRA. The total gravity-based civil penalty for these violations would be $879,347. However, because Erie satisfied all of the conditions of EPA���s Small Business Compliance Policy, and the economic benefit was insignificant, EPA waived the gravity-based civil penalty for the disclosed violations.
