The due date for 2001 was July 1, 2002; the Form R report was 225 days late. The due date for 2002 was July 1, 2003. The Form R was submitted November 19, 2003; the Form R report was 141 days late.

Orginally, a penalty of $11,241 was proposed in the Complaint. This amount was reduced to $2,788 to reflect the company's small business status. The penalty was further reduced in accordance with the Enforcement Response Policy for Section 313 of EPCRA. Schatz Bearing Corporation agreed to pay a penalty of $1,673.
