VIOLATIONS: The Respondent's facility was a point source discharge of pollutants, specifically oil field brine (produced water), to the receiving waters of a tributary of Skiatook Lake, located in the Northeast and Northwest Quarters of Section 33, Township 22 North, Range 10 East, Osage County, Oklahoma. The discharge of brine was documented during a October 27, 2003 inspection and from a spill which occurred on July 30, 2004 as indicated in NRC Report No. 730172.
RELIEF: The Class I Complaint proposes up to a $32,500 penalty for the violations. On 12/16/04 the EPA and Tallgrass discussed the EPA's penalty policy and what type of SEP would be appropriate to mitigate the proposed penalty. The SEP should be in the form of site restoration which will address lease maintenance and operations, as well as historic environmental degradation.
