This is the second of two Administrative Orders on Consent (AOC) involving the Pala Band of Mission Indians. This order addresses unauthorized discharges of dredge and fill material to Trujillo Creek, a tributary of the San Luis Rey River, in violation of Sections 301 and 404 of the Clean Water Act. The Pala Tribe must submit a Site Restoration Plan for removal of a road crossing and a rock barrier (rip rap) affecting Trujillo Creek. The AOC also requires an Off-Site Mitigation Project Plan, which may consist of (a) the purchase of credits in an approved mitigation bank; (b) the purchase of riparian habitat outside the Pala Tribe reservation to be preserved in perpetuity; or (c) the use of riparian habitat in a parcel already owned by the Tribe outside the reservation to be preserved in perpetuity.
