Respondent failed to make hazardous waste determinations for numerous waste streams, some of which Respondent generated regularly over an extended period of time; failed to comply with conditions for accumulating hazardous waste without a permit and thus did not qualify for the exemption from the permit requirement and stored containers of hazardous waste a period of at least ten years without a permit; failed to operate the facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to the air, soil or surface water which could threaten human health or the environment through pervasive unsafe waste storage and management practices throughout the facility; failed to close containers with hazardous waste when waste was not being added or removed; failed to separate hazardous waste and incompatible materials by means of a dike, berm, wall or other device; failed to, at least weekly, inspect areas where containers are stored, looking for leaks and deterioration caused by corrosion or other factors; and failed to store used oil in containers that were in good condition and clearly labeled with the words Âused oil. This Case Action seeks to bring a halt to the aforementioned activities and seeks compliance with SQG requirements.
