Summary

On December 5, 2019, the Court signed the settlement agreement resolving stipulated penalty claims for violations of the CAA Consent Decree in the matter of U.S., et al. v. Essroc Cement Corp. In settlement, Lehigh Hanson ECC, Inc., the new owner and operator of the cement plants at issue, agreed to pay a stipulated penalty of $2.1 million. The alleged violations involved exceeding emission limits at Essroc plants in Pennsylvania, West Virginia, and Puerto Rico as well as failing to continuously operate its air pollution control equipment at those plants and additional cement plants in Indiana. The Pennsylvania Department of Environmental Protection, the States of Indiana and West Virginia, and the Commonwealth of Puerto Rico are also parties to the Consent Decree and the stipulated penalty will be allocated among the parties.
