BioMarin had recurring violations of the federal pH-related specific prohibition, which prohibits a pH of less than 5.0 at any time. EPA found 62 violation days from 2004 through 2007. This Order requires BioMarin to pay a civil administrative penalty of $119,717, and to expend at least $50,270 on a supplemental environmental project (SEP). The SEP involves conducting stream restoration work to improve aquatic habitat, fish passage, and hydrologic function in Novato Creek and its tributary, Vineyard Creek.
