EPA issued an Administrative Order (ÂOrder or ÂAOÂ) to Whitefield, NH (ÂTown or ÂWhitefieldÂ) for violations of the effluent limits contained in NPDES Permit No. NH0100510 (ÂPermitÂ). The Town has discharged wastewater treatment facility (ÂWWTFÂ) effluent to the Johns River frequently in violation of the effluent limitations for recoverable copper included in its NPDES permit, and has periodically violated the biochemical oxygen demand (ÂBODÂ), total suspended solids (ÂTSSÂ), chronic whole effluent toxicity (ÂWETÂ), and minimum percent removal BOD and TSS limitations of the NPDES Permit.
The Order requires the Town to prepare and submit a copper optimization engineering report including a schedule for achieving full compliance with the copper limits contained in the Permit. The AO also requires Whitefield to prepare and submit a report summarizing measures that have been and will be taken to ensure more consistent compliance with Permit effluent limits that the Copper Optimization Engineering Report does not address. The Order includes interim limits for total recoverable copper and requires Whitefield to submit quarterly compliance status updates until it achieves compliance with its Permit limits
