This Settlement Agreement requires Triangle Park LLC to pay $1.2 million into a trust fund for cleanup, and includes a covenant not to sue pursuant to Sections 106 and 107(a) of CERCLA. The trust fund will be established pursuant to an existing Bona Fide Prospective Purchaser (BFPP) Agreement between the University of Portland and EPA.
