On March 24, 2009, EPA Region III issued a Unilateral Administrative Order to Brooke Glass Company and Henry A. Rithner, III in connection with the Brooke Glass Company facility located at 6th St. and Yankee St., Wellsburg, West Virginia (ÂSiteÂ). EPAÂs Order, issued pursuant to Section 106(a) of the Comprehensive Environmental Response, Compensation and Liability Act (ÂCERCLAÂ), requires the Respondents to, among other things, remove visibly arsenic-contaminated debris from buildings located at the Site and demolish those portions of the buildings that are collapsing or contaminated with arsenic.
